The Effective Date of these Listings Terms and Conditions is 1 May 2005.
Angus Council may change these Listings Terms and Conditions from time to time. You should therefore check the Effective Date each time you visit the Site.
By accessing and using the angusahead.com Listings service you are agreeing to these Listings Terms and Conditions.
These Listings Terms and Conditions shall be deemed to include any other policies, provisions or rules contained or referred to on angusahead.com including but not limited to the Terms & Conditions and the Privacy Policy.
If you do not agree to any of these Listings Terms and Conditions then you should not upload or attempt to upload any Listings information.
The angusahead.com Add & Edit Listings service is provided for the benefit of businesses, groups and individuals promoting attractions, services, businesses, organisations and events which must be based in Angus.
In accepting an entry for listing from any third party neither Angus Council nor any of its members, officers, or employees is promoting, supporting or endorsing an event or listing, unless and to the extent expressly agreed to in writing between Angus Council and the Promoter.
Angus Council reserves the right to refuse any Listing or to withdraw any Listing from the angusahead.com portal for any reason and at any time that Angus Council in its sole discretion may determine.
Without prejudice to the foregoing generality, Angus Council reserves the right to refuse any Listing or to withdraw from the angusahead.com portal any Listing which promotes or seeks to promote any event which
is or may be or contain or may contain material that is harmful, obscene, pornographic, defamatory, racist, violent, offensive, harassing, or is otherwise illegal or likely to cause offence to Angus Council or other members of the public.
It is the responsibility of the Event or Listing Promoter to ensure that the event or listing complies in all respects with all relevant laws and that all necessary licences, permissions or other approvals have been obtained.
It is the responsibility of the Event or Listing Promoter, to ensure that all Listings Content, including without limitation all information, data, images and logos submitted therewith, is accurate, lawful, non-discriminatory, non defamatory, does not contain unauthorised personal data, does not infringe the Copyright, trademark or other intellectual property rights of any third party and complies with all advertising laws and codes of practice from time to time in force.
If the Promoter is unsure as to the position of any Listings content the Promoter is responsible for obtaining his or her own legal advice.
The Promoter shall take all reasonable steps to ensure that any Listing that is placed on angusahead.com is and remains accurate and up to date. Listings which are not updated on an annual basis may be removed from angusahead.com.
The Promoter agrees to indemnify and hold Angus Council harmless against any claims actions or demands that may arise through the listing of the Promoter's event on angusahead.com or otherwise as the result of any Listings Content including without limitation, all information, data, images and logos submitted by the Promoter to the angusahead.com Add & Edit Listings service.
